PUBLIC NOTICE
CITY COUNCIL VACANCY
Events following the General Election of November 6, 2018 have resulted in a vacancy on the City Council of Moody, Texas.
The City Council met on November 16, 2018 and has decided to receive “Letters of Intent and Qualification” from City of Moody Citizens who desire to be considered for appointment to the vacant seat.
Each prospective Appointee to the City Council must provide the following information in writing and under oath:
In writing.
Signed and sworn to by the candidate.
The city secretary, city administrator, or court clerk may administer the oath for applications for a place on the ballot(application packet for appointment) for city offices. [Sec. 602.002(15)]
Indicates the date that the candidate swore to the application; (for the purpose of this appointment the term candidate and applicant are synonymous)
Timely filed with the appropriate authority; and
Includes:
The candidate’s name.
NOTE: An affidavit that any nickname provided for the name as it is to appear on the ballot is the nickname by which the candidate has been commonly known in the community for at least 3 years. [Sec. 52.031(c)].
A Secretary of State application for candidacy fulfills all the following:
(a modified form fulfilling these requirements may be picked up at City Hall; this is a modified application for a place on a general election ballot thereby fulfilling the requirements for a legal candidate and being appointed to the City Council)
The candidate’s occupation.
The office sought, including any place number or other distinguishing number.
A statement that the candidate is a United States citizen.
A statement that the candidate has not been finally determined mentally incapacitated or partially mentally incapacitated without the right to vote by a court with probate jurisdiction.
A statement that the candidate has not been finally convicted of a felony from which the candidate has not been pardoned or otherwise released from the resulting disabilities.
The candidate’s date of birth.
The candidate’s residence address, or if the residence has no address, the address at which the candidate receives mail and a concise description of the location of the candidate’s residence.
The candidate’s length of continuous residence in the state and in the territory from which the office sought is elected as of the date that the candidate swears to the application.
A statement swearing to defend the Constitution and laws of the United States and Texas.
A statement that the candidate is aware of the nepotism law.
A public mailing address for campaign correspondence if available, and any available electronic mail address at which the candidate receives correspondence relating to the candidate’s campaign. (Sec. 141.031)
In addition to the above information please submit a one page; ‘Letter of Intent and Qualification’ expressing:
A) one’s desire to serve
B) your personal qualifications
C) and any experience pertinent to the Office of Alderman
(forms and examples may be obtained at Moody City Hall)
ALL APPLICATIONS MUST BE RECEIVED BY CITY ADMINSTRATOR WILLIAM STERLING NO LATER THAN 5:00pm ON DECEMBER 5, 2018.
APPLICANTS WILL ALSO NEED TO BE PRESENT FOR INTERVIEW BY THE CITY COUNCIL ON DECEMBER 11, 2018 @ 6:00pm.
